Application, Review and Award Process
In order to be considered all bid responses must be prepared in accordance with the provisions of the solicitation. Questions concerning the solicitation must be submitted in writing to the contact person listed in the solicitation.

The successful consultant will be expected to execute a contract with MTC that contains certain standard provisions. Any exceptions to terms of the contract must be clearly stated in the consultant's bid response, are strongly discouraged, and may serve to disqualify the bid response.

It is the sole responsibility of the consultant to see that its bid is received before the solicitation deadline. In submitting a bid response, the consultant agrees that the entire response remains valid for sixty (60) days. This period may be extended by mutual agreement. MTC reserves the right to proceed no further with a bid response deemed not sufficiently responsive.

A solicitation does not commit MTC to award a contract, pay any costs incurred in preparing a bid response, or procure or contract for services or supplies. MTC reserves the right to accept or reject any or all bid responses received, negotiate with all qualified responders, or cancel or modify the solicitation in part or in its entirety when it is in the best interest of MTC.

Proprietary Information
As a public entity, MTC is subject to the Massachusetts Public Records Law. Documents and other materials made or received by its employees are subject to public disclosure unless MTC chooses to assert an applicable exemption. The exemptions applicable to materials submitted to MTC are provided by M.G.L. c. 40J, secs. 4c and 12(h), which afford confidentiality to "trade secrets or commercial or financial information regarding the operation of any business conducted by an applicant for, or recipient of any form of assistance" available from MTC or information "regarding the competitive position of such applicant or recipient in a particular field of endeavor." Submission of information to MTC and its treatment upon receipt are governed by the procedures available here.
